Terms and Conditions for Use of Third-party Wallets

Introduction

The following terms and conditions (the “Terms for Use of Third-party Wallets ”) govern your use of your SumUp Pay Card when you add, attempt to add, keep or use your SumUp Pay Card in a Digital Wallet ( the “Wallet”).

These Terms for Use of the Wallet also represent your agreement with SumUp regarding the use of your eligible Card with the respective Wallet Service. These Terms for Use of Third-party Wallets are in addition to SumUp’s Personal Service Terms and Conditions that apply to your use of SumUp’s Services, your SumUp Pay Wallet and the SumUp Pay Card connected to it.

You must accept these Terms for Use of Third-party Wallets to avail the respective Wallet Service. Your Terms with SumUp continue to apply in full to transactions made using the Wallet Service. You understand that the Wallet Service is provided by the respective Wallet Service provider and your use of it will also be subject to the terms and conditions of the Wallet Service provider, and to any other third party agreements which apply. SumUp is not responsible for any agreements you enter into with the Wallet Service provider or with any other third parties in connection with the Wallet Service, and is not responsible for any service provided to you by the Wallet Service provider or by any third party engaged by the Wallet Service provider. We likewise are not responsible for any information or other services provided to you by the Wallet Service provider or any other third parties associated with the Digital Wallet service. We are not liable for any failure or performance of the Digital Wallet Service. Any transactions with your SumUp Pay Card will remain subject to other terms which may apply (for example those of MasterCard or Visa).

Using the Service of the Wallet

In order to use the Wallet Service, you must link your SumUp Pay Card to the Wallet directly through the SumUp Pay App, or by opening the Wallet app on your Device and following the on screen instructions (which may include security features like facial/ fingerprint recognition or entering a password).

You are required to have an eligible Device in order to use the Wallet Service. The Wallet Service provider, at its sole discretion, determines which devices are eligible to be used with the Wallet service.

The Wallet Service allows you to make purchases using the added SumUp Pay Card wherever the respective Wallet Service is accepted. The Wallet Service may not be accepted at all places where your SumUpPay Card is accepted.

Please note that contactless payment limits may apply depending on the retailer and payment terminal used.

We will display your recent Wallet transactions on the device for your convenience. You can turn this display off at any time within the Wallet.

If we replace your SumUp Pay Card, we will link your new Card to the Wallet automatically.

You are solely responsible for the accuracy of the data given by you when you register for the respective Wallet and when you authorise a Wallet transaction.

Fees

We do not charge you a fee for using the Wallet Service, however, you are responsible for any charges your mobile/ wireless carrier, the Wallet Service provider, or other third parties may impose.

Termination

You may stop using the Wallet Service with your SumUp Pay Card by removing your Card from the respective Wallet on your Device.

If your Account or Wallet is terminated, or your Card is blocked or suspended in accordance with the Terms, then registration of SumUp Pay Card with the Wallet will be automatically terminated.

We can terminate these Terms for Use of Third-party Wallets by giving you at least two months’ notice. Any termination of these Terms for Use of Third-party Wallets is without prejudice to any accrued rights and/or remedies.

Security

The security provisions of the Terms apply to your use of your SumUp Pay Card with the Wallet. We encourage you to remind yourself of them before you start using the Wallet. You must take all reasonable steps to maintain the confidentiality of any information shown or stored on your Device in connection with your use of the Wallet. You are solely responsible for the safety and security of your Device. If your Device is lost or stolen, or you have reasons to believe that your Device has been compromised, you must contact us immediately and use all reasonable endeavours to deactivate your SumUp Pay Card from your Wallet. In the event of unauthorised transactions or incorrect payments, please refer to relevant provisions of the Terms.

Please make sure you delete all relevant information from your Wallet app when you change your Device.

Personal information

We will process your personal information in order to allow your SumUp Pay Card to be used for the Wallet, so please read our Privacy Policy, so you are aware of what we do with personal information about you. However, please note you will also be subject to the privacy policies of the respective Wallet Service provider, so please read them carefully. We and the Wallet Service provider share certain personal information with each other for a number of reasons, including to improve our and its service, to verify information and to prevent fraud.

Changes to the Wallet

The Wallet Service Provider may change the Wallet Services at any time, or cease to offer it. You should check with the Wallet Service Provider for more information.

SumUp’s Liability

The Wallet Service is provided by the respective Wallet Service Provider and relies on other third parties such as your mobile/ wireless carrier in order to function. We cannot be responsible for any delay, interruption or other event that prevents you from using the Wallet Service. SumUp is not responsible for any errors or failures due to any malfunction of your hardware or software, the unsuitability of your Device, or any virus, or problem that may be associated with the use of the Device or its software.
